(Johannessen) IHSS, Criminal record This bill would prohibit a person from providing in-home supportive services any employer without first obtaining a criminal record clearance. The bill would establish procedures for obtaining the criminal record clearance from the Department of Justice, which would be required to ascertain whether the employee has an arrest pending final adjudication for, or has been convicted of, any felony, any sex offense, or any offense involving theft as those terms are defined under the bill. The bill would permit persons providing services on January 1, 2002, to continue providing these services without complying with the bill until April 1, 2002, and would require a county, public authority, or entity contracting with a county to provide in-home supportive services to notify these providers of the requirements of the bill.
